Comprehensive Guide About Dependent Temporary Residence Card for Foreigners in Vietnam

In recent years, the number of foreigners residing and working in Vietnam has significantly increased. Recognizing the growing need to sponsor foreign relatives, EZ is pleased to provide detailed information on temporary residence cards for foreigners in Vietnam.

I. What is  Dependent Temporary Residence Card (TT TRC)?

A temporary residence card is a long-term visa that allows foreigners to visit relatives who are either working in Vietnam or are Vietnamese citizens. This card enables your family members to stay in Vietnam for an extended period, facilitating visits, tourism, and daily life. The maximum duration of a temporary residence card is 2-3 years.

II. Who is Eligible for a Temporary Residence Card?

1. Foreigners whose spouse is a Vietnamese citizen.
2. Foreigners whose father or mother, or both, is a Vietnamese citizen.
3. Foreigners under 18 years old with grandparents who are Vietnamese citizens and have a guardianship certificate from their biological parents.

III. Application Process and Procedures:

A. Cases where the foreign sponsor is eligible for a temporary residence card:

• Foreigners who have been granted a temporary residence card or are eligible for one can sponsor their relatives for a temporary residence card.
• The duration of the sponsored relative's card cannot exceed that of the sponsor's card

1. Eligible applicants under this category:

• Foreigners under 18 whose parent has a temporary residence card or is eligible for one.
• Spouses of foreigners who have a temporary residence card or are eligible for one.
• Other cases not mentioned above (e.g., children over 18) are eligible for a maximum 6-month visa (not a temporary residence card).

2. Required documents

For the Foreign Sponsor:

• Certificate of Business Operation: This document confirms the legal operation of the company or organization where the foreign sponsor is employed.
• Certificate of Seal Registration: This certifies the official seal of the company or organization.
• Passport and Temporary Residence Card (if applicable): The original passport and, if available, the temporary residence card of the foreign sponsor.
• Form NA6: Letter and application for granting a temporary residence card to a foreigner.
• Form NA8: Declaration form for requesting a temporary residence card.

For the Foreign Applicant:

• Original Passport: The original passport of the person applying for the temporary residence card.
• Temporary Residence Registration Certificate: This can be obtained through online registration or in-person registration at the local ward police station.
• Two 2x3 cm photos: Recent passport-sized photos with a white background.
• Certificate of Family Relationship: This could be a marriage certificate, birth certificate (for children sponsored by parents), or other relevant documents proving the relationship between the sponsor and the applicant.

Note: Documents in foreign languages must be legalized by the consular authority and notarized translated into Vietnamese.

B. Cases where the foreign applicant has a Vietnamese relative as sponsor:

1. Eligible applicants:

• Foreigners whose spouse, parents, or grandparents are Vietnamese citizens. Foreigners under 18 with grandparents who are Vietnamese citizens and have a guardianship certificate.
• The duration of the temporary residence card is 2-5 years.

2. Required documents:

For the Foreign Applicant:

• Proof of Relationship with the Vietnamese Sponsor: Documents that establish the familial relationship between the foreign applicant and the Vietnamese sponsor.
• Form NA7: Application for sponsorship and granting of a temporary residence card to a foreigner.
• Form NA8: Declaration form for requesting a temporary residence card.
• Original Passport and Visa: The original passport and visa of the foreign applicant.
• Two 2x3 cm photos: Recent passport-sized photos with a white background.
• Temporary Residence Registration Certificate: This can be obtained through online registration or in-person registration at the local ward police station.

For the Vietnamese Sponsor:

• National ID Card: The original national ID card of the Vietnamese sponsor.
• Proof of Relationship with the Foreign Applicant: Documents that establish the familial relationship between the Vietnamese sponsor and the foreign applicant. Examples include marriage certificate, birth certificate, or family relationship certificate.
• Form CT07: Residence information confirmation form.

Note:

• Documents in foreign languages must be legalized by the consular authority and notarized translated into Vietnamese.
• Documents issued by Vietnamese government agencies require certified copies.

IV. Submission of application:

• Applications should be submitted to the Immigration Department or the Provincial/City Public Security Department's Immigration Office where the company is headquartered.

V. Processing time:

• The processing time for temporary residence card applications is 5-6 working days from the date of submission.
